TERMS OF SUBMISSION
By requesting Wired Digital Inc. ("Wired Digital") to publish your script or code ("Code") in the Webmonkey Code Library (the "Library"), you ("You") are accepting all of the terms and conditions for Code submission set forth below and the terms and conditions of the public use licenses incorporated by reference herein.
As Between You and Wired Digital:
You hereby grant to Wired Digital a perpetual, worldwide, irrevocable, transferable, royalty-free and non-exclusive license to perform, display, distribute, reproduce, use, sublicense, and create derivative works of the Code for both commercial and non-commercial purposes. You represent that You have all rights in the Code necessary to grant the licenses to the Code provided to Wired Digital herewith. You agree to notify Wired Digital promptly if You discover any errors in the Code.
Wired Digital reserves the right for any reason to remove without notice any Code from the Library and the right to deny in its sole discretion access to the Webmonkey site or any portion thereof without notice.
Wired Digital will only accept Code if it is subject to a public use license at least as open and nonrestrictive as the Webmonkey Public License, that is to say that Users shall have the worldwide, irrevocable, transferable, royalty-free, and non-exclusive license, subject to third party intellectual property claims, to use, reproduce, modify, display, perform, sublicense and distribute Your Code for both commercial and non-commercial purposes, with or without modifications or as an integrated part of a larger work. If You do not expressly indicate a preferred public use license to accompany or include with Your submitted Code, it shall be deemed subject to the terms and conditions of the current version of the Webmonkey Public License, and will be labeled as such, until You provide Wired Digital with written instructions to the contrary.
When submitting Code to Wired Digital, You agree not to perform the following prohibited acts:
- Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless the User owns or controls the rights thereto or has received all necessary consents.
- Falsify the origin or source of software or other material contained in a file that is uploaded.
- Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
- Download any file that the User knows, or reasonably should know, cannot be legally distributed via this Web site.
- Delete any author attributions, legal notices, or proprietary designations or labels in any file that is uploaded.
- Defame, harass, threaten, or otherwise violate the legal rights of others.
- Publish, post, distribute, or disseminate any defamatory, infringing, obscene, indecent, or unlawful material or information.
- Advertise or offer to sell any goods or services, or engage in surveys, contests, or chain letters for any commercial purpose.
IN NO EVENT SHALL WEBMONKEY, WIRED DIGITAL INC., OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR POSTING OF THE CODE OR OTHERWISE ARISING OUT OF YOUR USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WIRED DIGITAL HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES / JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
I agree with the foregoing terms.
